Table 5's benchmark row is the main estimate.] **Billionaires who moved out in time, 0 counted by name.** The benchmark taxes everyone resident in California on 1 January 2026, whether or not they leave afterwards. Moving after that date does not avoid the tax, and moving before it meant uprooting personal and business ties, not just reincorporating; attorneys who practice in this area "are skeptical that any billionaires have successfully changed their California residency" (p.21). Forbes changed three residencies in 2026, but the press reports "do not include sufficient information to establish that they successfully changed residence before the January 1st, 2026 cut-off" (p.23, footnote 30). Removing four named leavers is Table 5's aggressive row 3 (p.26). **Chance the tax does not survive litigation, none.** The scoring takes the Act as written; BSZ themselves give no argument and point (p.18) to the companion legal report by Galle, Gamage and Shanske (revised 9 January 2026). There: the tax "fits well within California's power to tax", the challenges "are mostly just very old arguments that courts have rejected over and over" (report p.1; takings, retroactivity, novelty on pp.1 to 4), and on delay they are "frivolous or low-merit theories that courts have repeatedly rejected", met by the Act's expedited review in the California Supreme Court and the "pay first, litigate later" rule of tax cases (report pp.5 to 6). **Share of income tax lost, 5%.** The 10% avoidance and evasion allowance covers every behavioural response (p.23). It comes from the companion scoring note by Galle, Gamage, Saez and Shanske (July 2026, p.4): 61% of the wealth is listed stock recorded with the SEC, private holdings leave transaction records, and 250 taxpayers "can be carefully audited", hence "a relatively small avoidance rate of 10%". The 10% also matches the mobility literature, in a different exercise: with a semi-elasticity of 10 (Spain, Agrawal et al., 8 to 10; Switzerland, Brülhart et al., footnote 35) "a 1% permanent wealth tax reduces the wealth tax base by 10%" (Section IV.B, pp.28 to 29); the scoring applies that 10% to a one-time 5% tax, a step the paper does not spell out. The split is BSZ's own assumption: "If we assume that half of the 10% avoidance takes the form of mobility", 5% of billionaires' California income tax leaves, $0.15 billion a year (p.24; Table 5 notes, p.39). **Billionaires' yearly California income tax, about $3 billion.** Same starting table as JR, the FTB's $10 million-plus bracket, and a Pareto extrapolation to the top N earners, N the Forbes count each year (187 in 2023). Then the step the paper calls "most important": top wealth holders are not top earners and "have about 50% of the income of top income holders", from Balkir et al.'s match of the Forbes 400 to IRS returns (Appendix B, p.55). Their tax rate is 92% of the bracket's, for charity; the pass-through tax the FTB tables omit is added back. Result: $3 billion a year on average over 2019-2025 (p.11). Footnote 13 names the gap: JR put billionaires at 78.4% of top earners' income. Balkir's direct data imply the method runs high; the top four, from SEC filings, pay $268 million a year (Table 3, p.37). **How long the lost income tax is counted, five years.** For a truly one-time tax, behavioural responses are temporary: leavers return, or new fortunes replace the old (p.22); assuming one-time revenue but permanent losses is, in footnote 29, "the main flaw in the scoring analysis of Rauh et al." Table 5 takes no stand on duration, and its notes call the loss "annual but temporary if the wealth tax is one-time" (p.39); "if they last say only 5 years, the duration of the wealth tax payments", the losses are smaller than the extra income tax from asset sales (p.27). Leaving after 1 January can only be due to expected future wealth taxes (Section IV.B, p.27). <a class="corner-btn" href="#gap-summary">← Back</a> --- name: defense-jr class: defense-slide # The JR analysis: its own defense of each choice .src[Pages are PDF pages of Jaros and Rauh (2026), NBER chapter c15504, September 2026 (the printed page number is one behind the PDF page).] **Billionaires who moved out in time, 7.** Seven departures were "identified through media reports" between the initiative's filing in October 2025 and the residency snapshot of 1 January 2026: Page, Brin, Thiel, Hankey, Spielberg, Kalanick and Sacks, 28.5% of the domestic wealth base (Section 4.3 and Table 7, p.21). Under the collectibility framework a confirmed departure fails the "more likely than not" test and leaves the recognized base (Section 4.2, p.20). The paper calls the count "a floor" (p.22) and treating these seven as the whole response "extraordinarily conservative" (p.23). **Chance the tax does not survive litigation, 50%.** A novel tax with no judicial precedent should not be booked at face value. The yardstick is GAAP, the US accounting rules for company financial statements; its Topic 740-10 (income taxes; the rule for uncertain tax positions, formerly FIN 48) lets a company count the benefit of a disputed tax position only if it is "more likely than not", above 50%, to be sustained on its technical merits, and then only the largest amount with more than a 50% chance of being realized. The paper applies that gate to the revenue side and multiplies the recognized base by q = 0.50, which it calls conservative, since a strict threshold would book the full amount once survival exceeds 50% (Section 4.2, pp.19 to 20; equations 6 and 7, p.23). **Share of income tax lost, 45%.** The confirmed departures took 28.6% of the wealth base, and that count is "a floor" because it holds only publicly documented moves (p.24); with post-snapshot and reported moves the base loss is about 42%, which "matches the Swiss baseline of 41.1 percent almost exactly" (Table 8, p.25). The share of income tax that leaves "is not the same object" as the share of wealth, so f asks whether the leavers paid more or less than a proportionate share; the paper draws it uniformly on 0.30 to 0.60, "centered conservatively around the observed wealth-base departure fraction", midpoint 0.45, the range also covering departures "not publicly documented" (pp.31, 33). The conclusion needs less: the net present value turns negative once 23.7% of the income tax base leaves at 3% for r minus g, 35.6% at 4.5% (Table 10, p.34). **Billionaires' yearly California income tax, $4.55 billion.** The FTB's $10 million-plus bracket: 4,729 filers, $11.1 billion of tax; a Pareto fit gives its top 212 filers 39%, $5.76 billion at 2024-25 collections (pp.26 to 27). That is the upper bound, since it assumes the 212 billionaires are the 212 top earners; "ranking by wealth breaks the link with the tax base" (p.28). Instead of outside data, the paper draws the 212 at random from the top K positions; K of 500, "roughly the top decile of the bracket", gives $3.31 billion, the lower bound (Table 9, p.30). The central case is the midpoint, $4.55 billion (p.33): a discount of about a fifth on the top earners, against BSZ's one half. Footnote 29: the range omits capital gains realized on departure and other levies, which "likely more than compensates". **How long the lost income tax is counted, for ever.** The lost income tax is valued as a growing perpetuity, f times C over r minus g (Section 5.2, equations 13 and 14, p.31). Departed billionaires are assumed not to return because the conditions persist after collection: the constitutional cap on intangible property taxation is permanently removed, section 50310 lets the Legislature amend any part of the Act by a two-thirds vote, and the spending the Act funds is open-ended (p.32; Section 6, pp.36 to 37). The asymmetry is "not a modeling assumption but a feature of the Act's structure", and the same conditions deter new entry (p.33). <a class="corner-btn" href="#gap-summary">← Back</a> --- name: decisions class: head-small, defense-slide, decisions-slide # Decisions this comparison makes .src[The two papers answer different questions in different units.
